Terms of Service

These Terms govern your use of Azayon, a CRM service operated by Peskaya Limited ("we", "us"). By creating an account or using Azayon, you agree to these Terms. If you don't agree, don't use the service.

We've kept this short. If anything is unclear, email hello@azayon.com.

1. Your account

You must be at least 18 years old and able to enter into a binding contract. You're responsible for everything that happens under your account, including the actions of team members you invite. Keep your password secret. If you suspect unauthorised access, email us immediately.

2. The service

Azayon provides a customer-relationship-management ("CRM") tool with features including a deal pipeline, contact management, task management, automations, invoicing, and integrations. Specific features available depend on your subscription plan.

We may add, modify, or remove features over time. We won't materially reduce the core features of the plan you're paying for without notice.

3. Billing & refunds

Pricing

Current prices are listed at azayon.com/#pricing. The Growth plan is KES 3,000 per month or KES 25,000 per year when billed annually. Prices are inclusive of any applicable VAT.

We may change pricing for new subscriptions at any time. For existing paying subscriptions, we'll give at least 30 days' notice before any price increase takes effect.

Payment

Payments are processed by Paystack. You can pay via M-Pesa, debit card, or bank transfer. Subscriptions auto-renew at the end of each billing cycle until cancelled.

Refunds

We do not provide refunds for partial billing periods. Cancel any time to stop the next renewal; you'll keep access until the end of the period you've already paid for.

Failed payments

If a renewal payment fails, your account enters a 5-day grace window — your subscription stays active during that time and we'll show a banner in the app reminding you to update your payment method. If we can't collect payment within the grace window, your account moves to the Free plan automatically. No data is deleted.

4. Free trial

New accounts get 7 days of access to premium Growth features — automations, AI tools, file attachments and webhooks. Standard Free-plan limits on users, contacts and deals apply during the trial; upgrade to Growth to lift them. No card is required to start. After 7 days, if you don't subscribe, your account moves to the Free plan automatically. Your data stays — nothing is deleted.

We may change or end the trial offer at any time, but doing so won't shorten any trial that's already in progress.

5. Acceptable use

You may not, and you may not permit anyone using your account to:

• Use Azayon to send spam, harass, defraud, or violate anyone's rights or applicable law;
• Reverse-engineer, decompile, or attempt to extract our source code, except as expressly allowed by law;
• Interfere with the service — e.g. attempting to overwhelm it, scrape it at high volume, or probe for vulnerabilities without permission;
• Resell, white-label, or sublicense Azayon without our written agreement;
• Use Azayon to store data you don't have a lawful basis to store — for example, sensitive personal data without the subject's consent;
• Build a competing product using insights gained from your access to Azayon.

If you find a security issue, please report it responsibly to hello@azayon.com. We'll work with you to fix it before it's disclosed publicly.

6. Your data

The contacts, deals, tasks, documents and other content you put into Azayon ("Customer Data") belong to you. You grant us a limited licence to host, store, copy, and process Customer Data only as needed to provide the service.

You can export Customer Data at any time. CSV export is available for contacts, deals and tasks; for anything not covered by built-in export, email us and we'll help.

How we handle personal data is described in our Privacy Policy. By using Azayon you agree we may act as your data processor for personal data you upload, and you agree to act as the data controller for that data — including ensuring you have the right to upload it.

7. Intellectual property

Azayon — including its software, designs, brand, and documentation — is owned by Peskaya Limited and protected by copyright and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use Azayon under these Terms. Nothing in these Terms transfers ownership to you.

If you give us feedback or suggestions about Azayon, we may use them without obligation.

8. Third-party services

Azayon connects to third-party services such as Paystack (payments), Cloudinary (file storage), Meta WhatsApp Business Platform (notifications), Anthropic (AI features), and any integrations you set up yourself (e.g. n8n webhooks). We're not responsible for those services' availability, behaviour, or terms. When you use them through Azayon, their terms also apply.

9. Term & termination

Termination by you

Cancel your subscription any time from Settings → Billing. You'll keep access until the end of the period you've paid for, then move to the Free plan. To delete your account entirely, email hello@azayon.com.

Termination by us

We may suspend or terminate your account if you breach these Terms in a material way and don't fix it within 14 days of notice, or immediately for serious breaches (fraud, illegal use, security threats). We may also terminate the service entirely with at least 60 days' notice, in which case you'll receive a pro-rated refund of any prepaid fees and a chance to export your data.

What happens after termination

We delete your data within 30 days of account deletion, except where we're legally required to retain it (see the Privacy Policy). Sections that by their nature should survive termination — including 6 (your data), 7 (IP), 11 (liability), 12 (indemnity) and 14 (governing law) — survive.

10. Warranties & disclaimers

11. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law — for example, liability for fraud, gross negligence, or death/personal injury caused by negligence.

12. Indemnification

You agree to defend, indemnify and hold harmless Peskaya Limited and its directors, employees, and agents from any third-party claim arising from (a) your use of Azayon in breach of these Terms, (b) Customer Data you upload that infringes someone's rights or violates the law, or (c) your negligence or wilful misconduct.

We'll give prompt notice of any claim and let you control the defence (with our reasonable cooperation), provided you don't agree to any settlement that imposes liability or obligations on us without our consent.

13. Changes

We may update these Terms from time to time. If a change is material, we'll email registered users and post the change here at least 14 days before it takes effect. By continuing to use Azayon after a change takes effect, you accept the new Terms. If you don't accept them, cancel your account before the effective date.

14. Governing law

These Terms are governed by the laws of the Republic of Kenya. Any dispute that can't be resolved informally will be settled by the courts of Nairobi, Kenya, and you and we agree to that exclusive jurisdiction. Nothing here prevents either party from seeking urgent injunctive relief in any competent court.
